I have a question. My home was built in 1991 in Idaho Falls. The builder
was not a contractor. The heating system is a ground source heat pump that
does not gererate much heat. There was NO ductwork put in. Just enclosed
spaces by sheetrock and cardboard. Did this meet code at all in 1991, or is
it a blatent violation? I am looking at a huge bill to put ductwork in a
finished home, and it has been suggested to me to sue the builder.

Was the home given an occupation certificate by a building inspector?
Are there other issues in addition to the inadequacy of the heatpump system?
Did you get a pre-purchase inspection done?
Did you know that the builder wasn't a contractor before you purchased?
Did the builder use a contractor to install the system?
1991 is a bit far back to use the within 7-year claim and even my PI expires
after 10-years. So I think that given that this installation has been in now
for 14-years - I'd say that the problem's all yours.

Damn , Are you from Oakdale, Louisiana where i live at. That is the part about
if you want to sue a contractor , You should first burn it down and start over
because insurance will pay more.

This is Turtle.

The fellow not being a contractor , Happening 14 years ago, and then decided to
do something about it 14 years later and not say anything at all or close to the
time the new unit may be put in. I don't think you have a chance for all they
will say is well you had no problem with it for 14 years and when it was getting
near buying a new system. you find a bad problem to sue about.

I should clear up a few things. The 'builder' lived in the home for a few
years. It has been sold twice since. I have lived in it for 4 years. The
heat pump recently died, and needed replacement. The contractor that was
going to replace it found the lack of ductwork, and the inpector won't let
them install any system without ductwork.

This is Turtle.

Your chances just got worst because of 2 other owners that owned it and the
ducting could have been redone / screwed up during one of their time spands of
ownership.
