Its not in the plumbing code. I dont even think its in the International
Residential Code that rain water is to be diverted through non
perforated pipe.

Your best bet is to contact the local building department and talk with
them about it. The best outcome is for the building inspector (if there
is one in your area) agrees with your concern and then goes to the
builder. You will likley see the problem corrected instantly.
