Do I Need a License?

| I am interested in setting up a web site where I match buyers and
sellers throughout the US with Agents. Agents would have to subscribe to
the service and pay a referral fee. Would I need a Real Estate License
or have a licensed rep in each of the 50 States.

Hey that is a great idea! And original too! I would be careful though, as
this cleaver original idea will soon be copied by others.
God, not another would be pimp. Get a clue, good agents don't buy leads,
desperate ones do. Why not provide a real service and charge buyers and
sellers to find quality agents who you have actually screened and can vouch
for? The problem is that lead pimps like yourself have no concept of the
value most agents bring to the table. To make a quick buck, you treat
agents like gypsies, tramps and thieves. Sadly, with the normalization
there are probably enough agents desperate enough to go for your lead
selling service that it will make you some money.
The worst part is rather than let agents who are as clueless as you are
leave the industry and find jobs where they can make money, interlopers like
you prolong the process and keep these people in the business by putting
them in contact with people who don't know how inept they are. The last
thing our industry needs is to have these inexperienced agents taking
overpriced listings they don't know how to market, or writing contracts that
will never close with unqualified buyers.
Why don't you find a business model in an industry you are a part of and
understand. If you were licensed yourself, you would not need to ask the
question in the first place. But, hey, even if I was in your shoes, I would
do my own research, and hire some good attorneys rather than rely on advice
from posters to a newsgroup.

to get a referral fee? How does it work if you are out of state?
If I wanted a sanctimonious opinions about a business plan I would give
you all the gory details and let you have at it.

If you sell leads, you don't need a license.
If you're fee is based on the sales of property, you need a license.
If you say "I'll give you this lead, and you pay me when the deal closes",
you're basing your fee on the sale of property, so you need a license.
I've worked referrals out of state. The selling agency wanted a copy of my
license.

| Your definately going to need a license if you are getting any kind of
referral fee from a Real Estate Agent or Broker. However, you may be to
develop the site, then let it build popularity and charge agents a
monthly or anual fee to use the service, and advertise on your site.
Or perhaps just work out some great affiliate products and generate
income from the traffic that you are getting.
