Actually may be a tough one for the feds. The question is whether a Realtor
can control the distribution of his listings. Given that this control has
always existed in certain dimensions how do you now say it is in restraint
of trade?

The Texas/Oklahoma thing is even more interesting. They are trying to tell
the State Regulatory Bodies that they must regulate real estate agent
services in particular ways or they will be in restraint of trade. The
problem here of course is that such regulatory bodies are inherently in
restraint of trade. The real estate costs would certainly be less if there
was no licensing or regulation. So from where does the Feds get authority
to say what will be included in the regs?

I suspect the Feds don't know the answer either...so they are trying to
jawbone compliance.
